Domestic Violence

Domestic Violence comes in many forms. It can be physical, mental, economic or a combination of any.

   
Physical Violence
 
The easiest to identify, but not always simple to get away from. If you are in danger, get out of the home and call 911. Worry about your belongings after that.
   
Mental Abuse
 

Degrading, threatening, and demeaning behavior and words constitute abuse. Over time, many victims start to blame themselves or think that this behavior is something they have to get used to. It is not.

   
Economic Abuse
 
If one spouse works or has exclusive control to the familiy's funds, he or she has a certain amount of control over you. If you are constantly told that you will not get any money unless something happens, or your basic necessities are being kept from you because you have no control over money, this can constitute abuse. Being unemployed or caring for kids is no reason to have no say in how money in the household is spent.
   
  PERSONAL PROTECTION ORDERS
A Personal Protection Order (PPO) is not a guarantee that someone will leave you alone. However, it should be filed if you feel you are in danger.

Personal Protection Orders are not criminal charges, but violating them can become criminal.

  1. You file a motion for a PPO.
  2. The other party might file an answer.
  3. There is a hearing, where you might answer questions from a Judge about the other person.
  4. The Judge either grants or denies the request for a Personal Protection Order, and includes conditions that the other party must follow.
  5. The othery party is either at the hearing, or is not. Either way, he or she gets notice of the Order.
  6. Either side can file a motion to modify or terminate the order.

AFTER A PERSONAL PROTECTION ORDER IS ISSUED, THE OTHER
PARTY COULD BE ARRESTED FOR ANY VIOLATION.

Any violation of the PPO results in a criminal contempt charge.
